Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs all outreach — email, phone calls, messages, and any other contact — that you initiate, schedule, or automate through FounderReply. It is part of, and incorporated into, our Terms of Service. By adding a lead or sending any outreach, you agree to this Policy.
1. Our filters are tools — not legal advice, and not a guarantee
FounderReply provides compliance filters and controls — including business-only targeting, do-not-contact and suppression lists, opt-out handling, line-type (mobile) blocking, and per-country calling-hours scheduling. These features are provided as tools to assist you. They are not legal advice, are not a guarantee that your outreach complies with any law, and their use does not shift any legal responsibility to FounderReply. Laws differ by jurisdiction and change over time; no automated filter can guarantee compliance with your specific circumstances.
2. You are solely responsible for your outreach
You — the customer — are solely and fully responsible for the legality of every message and call you send through FounderReply, and for the data you upload. This includes, without limitation, compliance with the U.S. Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing and do-not-call rules, the EU GDPR and ePrivacy Directive, and all other applicable marketing, privacy, anti-spam, and consumer- protection laws.
You represent and warrant that, for every lead you contact, you have a lawful basis and, where required, prior consent to contact them on the relevant channel, and that you will honor every opt-out, unsubscribe, and do-not-contact request promptly.
3. Prohibited use
You may not use FounderReply to:
- contact anyone without a lawful basis or required consent, or after they have opted out;
- send unsolicited bulk messages, spam, or deceptive, misleading, or fraudulent content;
- disable, circumvent, or work around the compliance filters, suppression list, or opt-out mechanisms;
- upload purchased, scraped, or otherwise unlawfully obtained contact lists;
- impersonate any person or organization, or misrepresent your identity or affiliation;
- contact numbers or addresses in violation of do-not-call registries or calling-time restrictions;
- harass, threaten, defraud, or harm any recipient, or violate any law or third-party right.
4. Consent attestation
Before sending outreach, an owner or administrator of your workspace must accept this Policy and affirmatively attest that they have a lawful basis to contact their leads, that they are responsible for compliance, and that they understand the enforcement terms below. We record that acceptance — including the accepting user, timestamp, and IP address — as evidence of your agreement.
5. Enforcement — suspension and termination
We enforce this Policy. If we determine, in our sole discretion, that you have violated it — or if your outreach generates excessive spam complaints, bounces, or opt-outs — we may immediately suspend or terminate your workspace, numbers, and account, in whole or in part, without prior notice and without refund. Our systems may automatically pause your outreach when negative-signal thresholds are exceeded.
We may also remove offending content, report unlawful activity to the relevant authorities or our providers, and cooperate with law-enforcement and carrier investigations. Suspension or termination is in addition to any other remedy available to us.
6. Indemnification
You agree to indemnify, defend, and hold harmless FounderReply and its officers, employees, and providers from and against any and all claims, damages, penalties, fines, losses, and costs (including reasonable legal fees) arising out of or related to your outreach, your data, or your violation of this Policy or any applicable law. This obligation survives termination of your account.
7. Changes and contact
